Consumer Rights Directive, Chapter 4, Article 18

This article is dedicated to analyze the topic of the delivery of goods in the context of the performance of contracts between traders and consumers. After the exegesis of the related provision, the author tries to identify the moment from which the trader can be considered as non-compliant with such obligation and the related consumer's right to ask for the termination of the contract. In the final part, it is taken into account such right of termination in the perspectives adopted both by the Italian Civil Code and by the Italian Consumer Code.
